Right to Work Checks and Acceptable Documents

We conduct thorough checks to ensure that all of our candidates comply with UK Visas and Immigration department requirements and have

Valid permission to be in the UK.
Current and valid permission to take up employment in the UK.

This is achieved by obtaining and checking one or a combination of documents within List A or List B as specified by the Home Office. If the candidate provides a document or documents from List A, this will establish an excuse for the duration of their employment. A document / documents from List B indicate that the individual only has limited leave to be in the UK and means that a check needs to be repeated at least every 12 months and, in some cases, every 6 months.

To demonstrate that the necessary steps have been taken to meet legislative requirements, we will:

Obtain appropriate original documents from List A or List B.
Satisfy ourselves that each document is original, genuine, valid, in date and has not been tampered with.
Check that the photograph and date of birth is consistent across all documents and with the appearance of the individual.
Check if the candidate has any restrictions relating to the type of work, they are able to do or the number of hours they are able to work, and ensure any work provided is within these parameters.
Use the Government’s Employer Checking Service to verify entitlement to work if we are unsure of their eligibility to work in the UK.
Take a colour copy of all relevant document(s) in a format that cannot be subsequently altered, sign and date it to state that the original was seen and verified and retain it in the candidate’s file. As a minimum the following should be copied:
  • The front cover and any pages of the passport/document giving personal details, nationality, signature, date of birth, and biometric details or photograph of the bearer. Where there is any doubt as to whether the passport presented by the applicant is legitimate, we contact the Home Office to make sure the passport for that country hasn’t changed: ukba.homeoffice.gov.uk/business-sponsors/preventing- illegal working.
  • The page showing the endorsement, which confirms that the holder of the passport/document is currently permitted to work.
Where there is an expiry date attached to the permission to work, ensure that a repeat check is diarised to take place prior to expiry and at least every 12 months thereafter.
Retain a copy of all documentation for the duration of the individual’s employment / assignment and for at least 2 years:
  • After a temporary worker has been sent a P45 by the company.
  • After a contractor has finished their last assignment provided by the company.
  • After the date of placement of a permanent employee.
  • After an employee has left the company’s employment.
Right to work in the UK documentation from staff or workers acquired as a result of TUPE (Transfer of Undertakings Protection of Employment) is obtained within 60 days following the date of transfer.
